1. Our Service

NimBuild AI provides the website, documentation, demonstrations, account tools, and purchase flow for NimBuild Starter. The Lifetime pack provides read-only access to the private NimBuild Starter GitHub repository and access to updates we publish for that edition.

NimBuild Starter is a production-grade AI SaaS template. It includes Firebase Google authentication with server sessions, Stripe subscription billing, a credit ledger and compensation flows, PostgreSQL with Drizzle, a Volcengine-powered AI copy workflow, admin operations, marketing pages, documentation, and English and Chinese localization.

The hosted website and the starter you deploy are different environments. These Terms apply to the hosted website and our delivery of purchased access. When you deploy the starter, you are responsible for operating that deployment, its providers, its data, and its legal compliance.

2. Accounts and GitHub Delivery

Some features require an account. You must provide accurate account information, protect your credentials, and be responsible for activity under your account. You must be at least 18 years old or the age of legal consent in your jurisdiction.

Lifetime access is delivered through a GitHub invitation. You are responsible for providing the correct GitHub username or GitHub-connected email. Do not share account credentials or transfer repository access to another person.

3. Purchases, Fees, and Credits

Prices and delivery terms are shown before checkout. Website checkout is processed by Creem. We do not receive or store your complete payment card details. Creem’s terms apply to payment handling, while these Terms and our Refund Policy govern the product we deliver.

Taxes, duties, bank fees, or currency-conversion costs may apply and are your responsibility unless stated otherwise.

Promotional or demonstration credits have no cash value, are not transferable, and may be limited by usage rules or expiration. Where a paid generation route deducts credits before provider work begins, supported failures are eligible for compensation through the site’s credit refund flow.

4. Intellectual Property and Source License

The website, documentation, brand assets, and other original content remain the property of NimBuild AI and its licensors. Your use of the source code is governed by the repository license included with NimBuild Starter.

Purchasing access does not assign ownership of the repository or website content to you. Your GitHub invitation provides a way to inspect and clone the source; it is not permission to represent the NimBuild website or brand as your own.

You retain ownership of content you submit. You grant us a limited, worldwide, non-exclusive, royalty-free license to store, process, transmit, and display that content as reasonably needed to operate and secure the service.

5. AI Features and Provider Boundaries

AI features use external AI providers, including Volcano Engine for supported generation workflows. Provider availability, capacity, models, output quality, and retention practices are not fully under our control.

Your prompts, uploaded media, generation settings, and generation history may be stored to provide, secure, and display the service. You should not submit sensitive personal, secret, or infringing material.

AI output may be inaccurate or incomplete and is not professional, legal, medical, or financial advice. You are responsible for reviewing output and determining whether it is appropriate for your use case.

6. Acceptable Use

• Violate applicable law or the rights of others
• Harass, deceive, or harm another person
• Distribute malware, attempt unauthorized access, or interfere with service security
• Misuse credits, automate abusive traffic, or circumvent usage limits
• Infringe intellectual property or submit unlawful material
• Use AI output in a jurisdiction or industry where that use is prohibited

7. Availability and Third Parties

We may add, change, suspend, or remove features. We do not guarantee uninterrupted access, provider uptime, or future availability of any third-party model, API, or external service.

Your use of GitHub, Google, Creem, Volcano Engine, Resend, storage providers, analytics services, and payment networks is also subject to their terms and policies.

8. Refunds and Disputes

Digital-source purchases are generally immediate-access purchases. Refunds are handled under our Refund Policy and applicable law. Contact support before filing a payment dispute so we can investigate and, where appropriate, correct delivery or billing.

9. Disclaimers and Liability

The service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the starter will meet every project requirement or be error-free.

To the maximum extent permitted by law, NimBuild AI is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, or business interruption. Our aggregate liability for claims connected to the service is limited to the amount you paid us for the purchase directly giving rise to the claim. Nothing in these Terms excludes liability that cannot legally be excluded.

10. Termination and Changes

We may suspend or terminate access for unlawful use, nonpayment, breach of these Terms, or protection of the service or others. You may stop using the service at any time.

We may update these Terms by posting a revised effective date. Material changes will be announced on the site or, where required, sent to account holders. Continued use after the effective date means you accept the update.
